Mediation Information and Assessment Meeting (MIAM)

If you’re thinking about taking a family matter to court, the first step is to attend a MIAM meeting (Mediation Information and Assessment Meeting).

Although it can feel daunting, this meeting is designed to help you explore your options in a safe, supportive way, not to push you into any particular choice.

MIAMs are held one-to-one so you have a private space to speak openly. Time is given to ensure your decision to consider mediation is truly yours and to check there are no safeguarding or safety concerns.

The purpose of the MIAM is to gently guide you through possible ways to resolve the issue and to help you decide whether court proceedings are really the best route for your family.

It is a required assessment, but it is not the same as committing to mediation.

MIAM meetings can be held remotely (for example, via Zoom) for your convenience, or in person.

The cost of a MIAM is £150 per hour.

There are limited exceptions to the requirement to attend a MIAM.

About Legal Aid

This private practice does not offer Legal Aid, but Legal Aid for MIAM meetings may be available through other local services depending on income and capital.

If one party is assessed as eligible for Legal Aid, it can cover the first mediation session for the privately funded participant.

Exemptions

Domestic Abuse Exemptions

    • If you’ve experienced domestic abuse, you may not need a MIAM. This includes:

      • Police involvement or arrests

      • Court orders or injunctions

      • Evidence from healthcare professionals

      • Support from domestic abuse organisations

      You will normally need to provide evidence of recent domestic abuse. If in doubt, you can attend a MIAM meeting and a mediator will assess suitability.

Urgency Exemptions

    • When time is critical, you may not need to attend a MIAM meeting:

      • Immediate risk of harm

      • Child abduction concerns

      • Significant financial hardship

Practical Exemptions

    • Mediation may not be possible if:

      • You do not have contact details for the other party

      • The other party is in prison

      • Bail conditions prevent contact

      • Either party lacks mental capacity

      • The other party is about to be made bankrupt and you wish to address financial remedies

Other Exemptions

  • Existing court proceedings
  • Child protection concerns
  • International elements
  • The other party is under 18
